By accessing or using ShipReady ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all visitors, users, and others who access the Service.

2. Description of Service

ShipReady is an AI-powered website launch readiness scanner. The Service analyzes publicly accessible websites for security, SEO, legal compliance, accessibility, and performance issues, and provides AI-generated remediation suggestions. Results are informational and not a substitute for professional legal, security, or technical advice.

3. Account Registration

Certain features of the Service require you to create an account. You agree to:

• Provide accurate and complete registration information.
• Maintain the security of your account credentials.
• Promptly notify us of any unauthorized use of your account.
• Accept responsibility for all activities that occur under your account.

You must be at least 13 years of age to create an account. By creating an account, you represent that you meet this requirement.

4. Acceptable Use Policy

You agree to use the Service only for lawful purposes. You must not use the Service to:

• Scan websites you do not own or do not have explicit permission to scan.
• Overload, disrupt, or degrade the performance of any website or service.
• Attempt to bypass rate limits, authentication, or security controls.
• Use the Service for competitive intelligence gathering in violation of another site's terms.
• Automate scanning at a scale that constitutes abuse of third-party websites.
• Submit URLs pointing to private, internal, or non-public network resources.
• Engage in any activity that violates applicable local, national, or international laws.

We reserve the right to suspend or terminate accounts that violate this policy.

5. Payments and Subscriptions

Paid plans are billed through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis according to the plan you selected.

• All prices are in USD and exclusive of applicable taxes.
• Subscriptions renew automatically unless cancelled before the renewal date.
• One-time purchases (Single Site plan) do not renew automatically.
• Refunds are issued at our sole discretion. Contact support within 7 days of purchase for refund requests.
• We reserve the right to change pricing with 30 days notice to existing subscribers.

6. Intellectual Property

All content, features, and functionality of the Service — including the scan engine, scoring algorithms, AI prompts, and user interface — are owned by ShipReady and protected by applicable intellectual property laws.

Scan results generated for your website are yours to use freely. AI-generated fix prompts are provided for your personal and commercial use. You may not resell or redistribute scan results in a competing product.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM:

• Any warranty that the Service will meet your specific requirements.
• Any warranty that the Service will be uninterrupted, timely, secure, or error-free.
• Any warranty regarding the accuracy, completeness, or reliability of scan results.
• Any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.

Scan results are provided for informational purposes only and do not constitute professional security audits, legal compliance certifications, or SEO guarantees.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SHIPREADY AND ITS OPERATORS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages.
• Loss of profits, data, goodwill, or other intangible losses.
• Damages arising from your reliance on scan results or AI-generated suggestions.
• Any interruption or cessation of the Service.
• Unauthorized access to or alteration of your transmissions or data.

In no event shall our total liability to you exceed the amount you paid to us in the twelve months preceding the claim, or $50 USD, whichever is greater.

9. Account Termination

You may cancel your account at any time from your account settings or by contacting support.

We may suspend or terminate your account immediately, without notice, for:

• Violation of these Terms or our Acceptable Use Policy.
• Fraudulent, abusive, or illegal activity.
• Non-payment of fees.
• Requests from law enforcement or government agencies.

Upon termination, your right to use the Service ceases immediately. Scan data associated with your account may be deleted within 30 days of termination.

10. Indemnification

You agree to indemnify and hold harmless ShipReady and its operators from any claims, damages, obligations, losses, liabilities, costs, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Service shall be resolved through good-faith negotiation first. If unresolved, disputes shall be submitted to binding arbitration.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last updated" date and, for significant changes, by sending an email to registered users. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
